These Terms and Conditions govern purchases made through the official Neural Odyssey shop during the periods in which the shop is active.
By placing an order, the customer acknowledges having read these Terms and Conditions and the other applicable policies published on the website.
1. The Neural Odyssey shop
Neural Odyssey is a music project that may make a limited selection of official merchandise available in connection with specific initiatives.
The shop may be activated, for example, in connection with the release of an album, an anniversary, a celebration or other events and initiatives related to the music project.
The shop is not necessarily available on a permanent basis. Opening periods may vary in duration and do not follow a predetermined schedule.
At the end of a specific initiative, the shop may be suspended and subsequently made available again in connection with future initiatives.
During periods in which the shop is closed, new orders cannot be placed.
The closure of the shop does not affect orders already placed or any rights relating to purchases made while the shop was active.
2. Products
The shop offers a limited selection of official Neural Odyssey merchandise, which may include clothing, accessories, merchandise and other products related to the music project.
Most products are manufactured using print on demand services.
This means that these products are normally manufactured after an order has been placed and may be produced and shipped from different fulfilment centres depending on the product, availability and destination of the order.
Neural Odyssey may also occasionally offer directly managed small production runs of products or merchandise connected with specific initiatives.
3. Limited editions and special events
In connection with certain initiatives, Neural Odyssey may make products available in limited quantities.
These initiatives may include, for example, an album release, anniversary, celebration, band related event or another special initiative.
The characteristics and contents of these editions are determined by Neural Odyssey and are not created or modified according to individual customer requests.
An edition may include additional items such as cards, prints, inserts, merchandise, promotional material, signed cards or other content associated with the initiative.
Limited editions are available only while the quantity allocated to the relevant initiative remains in stock.
The inclusion of additional items and the limited, numbered, commemorative or promotional nature of an edition does not affect any mandatory consumer rights provided by applicable law.
Small production runs managed and shipped directly by Neural Odyssey are available exclusively within the European market unless otherwise stated for a particular initiative.
4. Product information and images
We make reasonable efforts to describe and represent products as accurately as possible.
Images displayed in the shop may include photographs, mockups or digital representations intended to provide an accurate representation of the appearance and characteristics of the product.
Minor differences may occur between the representation displayed on a screen and the physical product, particularly in relation to colours, proportions, print positioning and the appearance of materials.
Colours may also appear differently depending on the display and settings of the device used by the customer.
The essential characteristics of each product are those stated on its product page at the time of purchase.
Normal variations resulting from the manufacturing process do not affect the customer’s rights where the product received is actually defective or does not conform to the product purchased.
5. Sizes and variants
Customers purchasing clothing should carefully review the size guide available on the relevant product page before placing an order.
Measurements may vary between different models, manufacturers and types of garment.
Customers should therefore check the measurements of the specific product as well as the selected size, colour and any other variants before confirming the order.
Receiving the size, colour or variant correctly selected by the customer does not constitute a defect or lack of conformity.
Any applicable right of withdrawal and other mandatory consumer rights remain unaffected.
6. Product availability
Print on demand products are available subject to production capabilities and the availability of models, materials, colours, sizes and other variants from our production partners.
The presence of a product in the shop does not guarantee that every variant will be available at all times or in every country.
In the rare event that a product already ordered cannot be manufactured or supplied, the customer will be informed and any amount already paid for the unavailable product will be refunded.
Limited editions are available only while stocks allocated to the relevant initiative last.
7. Prices
The prices applicable to an order are those displayed in the shop at the time the order is placed.
Applicable taxes are displayed or calculated according to the sales system and applicable law.
Shipping costs are displayed during checkout before the order is confirmed.
If an obvious pricing error occurs, the customer will be informed as soon as reasonably possible and may be offered the option of confirming the purchase at the correct price or cancelling the order and receiving a refund of any amount already paid.
8. Orders
Before completing a purchase, customers have the opportunity to review the selected products, quantities, variants, prices, delivery address and other information required to process the order.
The customer is responsible for ensuring that the information provided during checkout is accurate.
Once the order has been completed, an order confirmation will be sent using the contact information provided by the customer.
Adding a product to the shopping cart does not guarantee its availability until the order has been completed.
9. Order modifications and cancellations
As many products are manufactured on demand, production may begin shortly after an order has been confirmed.
Customers wishing to modify or cancel an order should contact us as soon as possible.
We will make reasonable efforts to make the requested change before production or shipment begins, but we cannot guarantee that modification or cancellation will remain technically possible once the order has entered processing.
The inability to modify or cancel an order that has already entered production does not affect any mandatory consumer rights, including any applicable statutory right of withdrawal.
10. Payments
Orders must be paid using one of the payment methods available in the shop at the time of purchase.
Payments may be processed by third party payment service providers.
Problems, refusals or delays directly attributable to the customer’s bank, card issuer or payment service provider will be handled according to the relevant service conditions and applicable law.
Nothing in this section limits any rights or responsibilities that cannot legally be excluded.
11. Print on demand production
Most Neural Odyssey merchandise is manufactured through partners specialising in print on demand production and fulfilment.
Depending on the product and delivery destination, an order may be manufactured and shipped from facilities located in different countries.
An order containing multiple products may in some cases be manufactured at different facilities and therefore delivered in separate shipments.
The use of an external production or fulfilment partner does not restrict any mandatory consumer rights.
For any issue relating to an order placed through the shop, customers must contact Neural Odyssey using the details provided in the Contact and support section rather than contacting the production partner directly.
12. Shipping and delivery
Available shipping methods, shipping costs and estimated delivery times are displayed during checkout where available.
For print on demand products, the total order fulfilment time includes both manufacturing time and shipping time.
Any delivery times displayed are estimates unless otherwise expressly stated or required by applicable law.
Circumstances outside our reasonable control, including carrier disruptions, customs procedures, adverse weather conditions, public holidays or other exceptional events, may result in delays.
Mandatory consumer rights relating to the delivery of goods remain unaffected.
13. International shipping
Products manufactured through print on demand services may be shipped to many countries worldwide.
The availability of shipping to a particular destination may depend on the product, available production facilities, carriers and any legal or logistical restrictions.
Not every product is necessarily available for delivery to every country.
Small production runs managed and shipped directly by Neural Odyssey are available exclusively within the European market unless otherwise stated for a particular initiative.
14. Customs duties and import taxes
Print on demand products may be manufactured and shipped from different facilities around the world.
Depending on the destination country and the location from which the order is shipped, customs duties, import taxes, handling charges or other fees imposed by local authorities or carriers may apply.
Where these amounts are not collected directly during checkout, they may be payable by the recipient upon importation or delivery.
Any applicable duties, taxes and other charges will be handled in accordance with applicable law and the information provided during the purchasing process.
15. Delivery address
The customer is responsible for providing a complete and accurate delivery address.
If a customer discovers that an incorrect or incomplete address has been provided, the customer should contact us as soon as possible.
We will make reasonable efforts to correct the address before production or shipment begins, but we cannot guarantee that a change will remain possible once the order has entered processing.
Additional costs resulting from an incorrect or incomplete address provided by the customer may be charged to the customer where permitted by applicable law.
16. Failed deliveries and returned packages
If an order is not delivered or appears to have been lost during transit, the customer should contact us so that the necessary investigation can be carried out with the carrier or production and fulfilment partner.
If a package is returned because of an incorrect or incomplete address, failure to collect the package or another circumstance attributable to the recipient, any additional costs necessary to ship the order again may be charged to the customer where permitted by applicable law.
17. Returns, withdrawal and refunds
Returns, refunds, replacements and statutory withdrawal rights are governed by the Refund, Return and Withdrawal Policy published on the website.
For consumers in the European Union, where applicable, the provisions of Directive 2011/83/EU on consumer rights and the corresponding national legislation apply.
Consumers in the European Union normally have 14 days from receipt of the goods to exercise their statutory right of withdrawal, subject to the exceptions provided by applicable law.
The fact that a product is manufactured through a print on demand system does not, by itself, exclude the statutory right of withdrawal.
For consumers in the United Kingdom, applicable statutory cancellation rights under the Consumer Contracts Regulations 2013 remain unaffected.
For customers located in other countries, any mandatory cancellation, return or refund rights provided by applicable local law remain unaffected.
18. Defective, damaged or non conforming products
If a product is defective, damaged, incorrect or does not conform to the order, the customer must follow the procedure described in the Refund, Return and Withdrawal Policy section.
Photographic documentation clearly showing the product and the reported defect, damage, printing error or lack of conformity is required in order to assess the issue.
Additional photographs may reasonably be requested where necessary to verify the issue or submit the claim to the relevant production partner.
For consumers in the European Union, statutory conformity rights under applicable national consumer legislation and Directive (EU) 2019/771 remain unaffected.
For consumers in the United Kingdom, statutory rights under applicable consumer protection legislation, including the Consumer Rights Act 2015, remain unaffected.
For consumers in Australia, consumer guarantees provided by the Australian Consumer Law apply where that legislation applies to the transaction and cannot be excluded by these Terms and Conditions.
For customers in other jurisdictions, any mandatory statutory rights relating to defective, damaged or non conforming goods remain unaffected.
If a defective or non conforming product belongs to a limited edition that has sold out, replacement with an identical product may no longer be possible. In such circumstances, an appropriate remedy will be provided where required by applicable law.
19. Complimentary gift vouchers and promotional credits
Neural Odyssey may occasionally provide complimentary gift vouchers, promotional vouchers, credits or promotional codes as part of marketing campaigns, prizes, special initiatives or activities involving our community.
Vouchers and credits provided free of charge do not represent money paid by the customer, cannot be converted into cash and cannot be redeemed for cash.
Unless otherwise stated in the terms of the relevant initiative, they are non refundable.
If an order paid wholly or partly using a complimentary promotional credit is refunded, any monetary refund will not exceed the amount actually paid by the customer using a monetary payment method.
Any promotional credit applied to the order may be restored, reissued or considered used according to the conditions of the relevant initiative.
These provisions apply exclusively to vouchers and promotional credits provided free of charge by Neural Odyssey and do not apply to gift cards purchased by customers for monetary value.
20. Promotions and discount codes
Neural Odyssey may occasionally offer promotions, discounts or promotional codes.
The duration, conditions and any restrictions applicable to a particular promotion may be specified separately.
Unless otherwise stated, promotional codes cannot be combined with each other and cannot be exchanged for cash.
We reserve the right to reject or cancel fraudulent or abusive use of a promotion in accordance with applicable law.
21. Intellectual property
Names, logos, symbols, graphics, illustrations, photographs, text, artwork, designs and other content relating to Neural Odyssey and displayed in the shop are protected by applicable intellectual property and copyright laws.
Purchasing a product does not transfer to the customer any intellectual property rights relating to graphics, logos, images or other content reproduced on the product.
A legitimately purchased product may be used, worn, given as a gift or subsequently transferred by its lawful owner.
Protected graphics and other content may not be reproduced or commercially exploited without permission except where permitted by applicable law.
22. Use of the shop
Customers agree to use the shop lawfully and not to interfere with its normal operation.
The shop must not be used to place fraudulent orders, intentionally provide false information, attempt to compromise the security of the website or use its content in violation of the rights of Neural Odyssey or third parties.
We reserve the right to refuse or cancel orders where objective circumstances provide reasonable grounds to believe that an order is fraudulent or unlawful, subject to applicable law.
23. Privacy and personal data
Personal data collected through the shop is processed as described in the Privacy Policy published on the website and in accordance with applicable data protection legislation, including Regulation (EU) 2016/679, GDPR, where applicable.
Where necessary to fulfil an order, the required personal data may be shared with service providers involved in payment processing, manufacturing, fulfilment and delivery.
Customers located outside the European Economic Area may also have additional privacy rights under the laws applicable in their jurisdiction.
24. Third party services
The operation of the shop may involve services provided by third parties, including payment systems, print on demand production services, fulfilment providers and shipping carriers.
The involvement of third party providers does not limit any rights that consumers may exercise against the seller under applicable law.
25. Shop closure
Neural Odyssey may suspend the shop at the end of a specific initiative or at another time, thereby preventing new orders from being placed.
The shop may remain closed for a specified period or until a future initiative, without following a predetermined schedule.
The subsequent reopening of the shop is not guaranteed.
Closing the shop does not modify or cancel orders already placed and does not affect customer rights relating to purchases made while the shop was active.
Support relating to existing orders will remain available even during periods in which the shop is not accepting new purchases.
26. Liability
To the extent permitted by law, Neural Odyssey is not responsible for delays or failure to perform obligations resulting from circumstances outside its reasonable control.
Nothing in these Terms and Conditions excludes or limits any liability that cannot legally be excluded or limited.
Nothing in these Terms and Conditions excludes, restricts or modifies any mandatory consumer guarantee, statutory warranty or other consumer right that applies to the transaction.
27. Changes to these Terms and Conditions
These Terms and Conditions may be updated to reflect changes to the shop, services used or applicable law.
The version applicable to an order is the version in effect when the order is placed unless otherwise required by law.
The date of the latest update is shown at the beginning of this page.
28. Applicable law and international consumer rights
These Terms and Conditions are governed by Italian law, without prejudice to any mandatory consumer protection rights that may apply under the laws of the country in which the consumer habitually resides.
For consumers in Italy, the applicable provisions include Legislative Decree No. 206 of September 6, 2005, the Italian Consumer Code, as subsequently amended.
For consumers in the European Union, mandatory rights arising from applicable European Union consumer legislation remain unaffected, including Directive 2011/83/EU on consumer rights and Directive (EU) 2019/771 on certain aspects concerning contracts for the sale of goods.
For consumers in the United Kingdom, mandatory rights under applicable consumer legislation, including the Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015, remain unaffected.
For consumers in Australia, where the Australian Consumer Law applies to the transaction, the consumer guarantees and remedies provided by that legislation cannot be excluded, restricted or modified by these Terms and Conditions.
For consumers in the United States, Canada and other jurisdictions, any mandatory consumer protection rights applicable to the transaction remain unaffected.
If any provision of these Terms and Conditions conflicts with a mandatory provision of consumer law applicable to the customer, the mandatory provision will prevail to the extent of that conflict.
